1. Agreement to Terms

Welcome to Myzie! By accessing or using our mobile application and services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

You must be at least 13 years of age to use Myzie. If you are between 13 and 17 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

If you do not agree to these Terms, you may not access or use our services.

2. Definitions

"Service" refers to the Myzie mobile application and all related features, content, and services.

"User" refers to any individual who creates an account or uses the Service.

"Content" refers to text, images, posts, goals, challenges, and any other materials submitted through the Service.

"AI Coach" or "Myzie" refers to our artificial intelligence-powered coaching feature.

"Subscription" refers to paid access tiers including Free, Plus, and Max plans.

3. Eligibility

Myzie is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If we become aware that a user is under 13, we will terminate their account and delete their data.

Users between 13 and 17 should have parental consent before using the Service. By using Myzie, you represent that you have the legal capacity to enter into this agreement.

4. Subscription & Billing

Myzie offers the following subscription tiers:

  • Free: Basic access with limited features
  • Plus: Enhanced features and additional AI coaching
  • Max: Full access to all features and unlimited AI coaching

Auto-Renewal Disclosure: Paid subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your payment method will be charged for the renewal unless you cancel.

You can manage or cancel your subscription through your device’s app store settings (Apple App Store or Google Play Store).

5. User Content & Conduct

You retain ownership of Content you create and share on Myzie. By posting Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your Content in connection with the Service.

Prohibited Content: You may not post Content that:

  • Is illegal, harmful, threatening, abusive, or harassing
  • Contains hate speech or discriminatory language
  • Infringes on intellectual property rights
  • Contains spam, malware, or deceptive content
  • Violates the privacy of others
  • Promotes self-harm or dangerous activities

5.1 Community Conduct

Myzie is a supportive community built around personal growth. When interacting with other users, you agree to:

  • Treat all community members with respect and kindness
  • Provide honest, constructive feedback when engaging with others’ goals
  • Respect the privacy and boundaries of other users
  • Not impersonate other users or misrepresent your identity
  • Not solicit, advertise, or promote external products or services

We reserve the right to remove content and suspend accounts that violate these community standards. Repeated violations may result in permanent account termination.

6. AI Coaching Disclosure

Important: Myzie is an artificial intelligence-powered coach. The AI provides guidance, motivation, and suggestions based on your goals and interactions.

The AI coach is not a substitute for professional advice. Myzie does not provide medical, psychological, financial, legal, or other professional advice. Always consult qualified professionals for such matters.

While we strive for accuracy, AI responses may contain errors or limitations. You should use your own judgment when following any suggestions provided by the AI coach.

7. Intellectual Property

The Myzie app, including its design, features, branding, and code, is owned by Indubitably Muffin LLC and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, or create derivative works of our Service without our prior written consent.

8. Termination

You may delete your account at any time through the app settings. Upon deletion, your personal data will be removed within 30 days, except where retention is required by law.

We may terminate or suspend your account if you violate these Terms, engage in fraudulent activity, or for other reasons at our discretion. We will provide notice where reasonably possible.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, error-free, or secure. We do not guarantee specific results from using the AI coach or any other features.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INDUBITABLY MUFFIN LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from the Service shall not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.

11. Indemnification

You agree to indemnify, defend, and hold harmless Indubitably Muffin LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms.

12. Dispute Resolution

12.1 Informal Resolution Before filing any claim, you agree to attempt to resolve disputes informally by contacting us at support@joinmyzie.com. We will work to resolve the issue within 30 days.

12.2 Binding Arbitration If informal resolution fails, all disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in the English language.

12.3 Governing Law These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles.

12.4 Class Action Waiver You agree to resolve disputes only on an individual basis. You waive the right to participate in class actions, class arbitrations, or representative actions.

12.5 Arbitration Opt-Out You may opt out of arbitration by sending written notice to support@joinmyzie.com within 30 days of creating your account. The notice must include your name, email, and statement that you wish to opt out.

12.6 Small Claims Exception Either party may bring claims in small claims court if the claim qualifies and remains in small claims court.

13. Changes to Terms

We may update these Terms from time to time. For material changes, we will notify you through the app or by email. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.
